Cheque bounce issue by the customer due to insufficient balance

23-Dec-2023 (In Cheque Bounce Law)
Hi,  I was duped by one of my customer in the month of October. I have food supplement business so my customer which had already bought products from me already two times but this time he asked me to take cheque as those days were many festivals so bank was not opened since one week. I received cheque of 2800 rs. amount on 8th oct, 2016 and submitted in my bank in start of next week. Due to insufficient fund in his account that cheque bounced and received back that bounced cheque in next week of dropping cheque. After all this he kept promising me lies and lie to give money in cash but never met me in personal and now even he stopped receiving my phone. I already told him to give my money otherwise will take action against it but he didn't take that seriously and took me granted. Well, now I want to take legal action against him so what will be the procedure and can I do it by my own or need to hire a lawyer for this issue. Please suggest. Thanks!!!

Yes u can take legal action against him. U can file a case u/s 138 of negotiable instrument act against such person. Or u can send a simple notice to him. Because ur amount is not too much then u r not affordable court case.

Please send legal notice to him by appointing an Advocate.

Once legal notice is sent to him then you can wait for 15 days for him to return your money.

If he does not returns the money within 15 days then you can file civil case for recovery of your money.
