Cheque Bounce Demand Notice in Cuttack. Lawyer for Notice in Cheque

One business partner gave me 2 cheques after closure of the business. I deposited 2 cheques in my bank. Bank send me a letter that 2 cheques have been Bounced. What should I do now. Whether I should send notice or file a case directly.

Note that, you have to send a demand notice to the drawer of the cheque within 30 days from the date of the receipt of the Return Memo from the bank. So do not delay.

You can not file a case directly in Court. First you are required to send a demand notice there by demanding him to return your legitimate dues within 15 days from the date of the receipt of the demand Notice.

If the drawer of the cheque pays you the cheque amount within 15 days, it's well and good. But if he does not do so, file a complaint case after the expiry of 15 days demand notice period.

in cheque Bounce case is adjudicate under the negotiable Instrument Act and under this act first we send demand notice and after the response/reply by the other party, if possetively then matter will subsided or if negative then after specified period as per above statu then we will fill a complain case.

You have to send them a Demand Notice by a lawyer only within 30 days of the return memo being produced to you. Further, after expiry of 15 days from the receipt of the demand notice to the other party and within 30 days after the expiry of 15 days, you have to initiate a case before the District Court, Cuttack. Cheque bounce cases are criminal offence.
