Cheque bounce case ' criminal and civil case
22-Oct-2023 (In Cheque Bounce Law)
I given 62 lakhs to one of friend's father on friendship basis on grounds of return in 3 months in June to August 2014.
As he is not paying back, I taken undated cheques, one dated 31.12.2015 promissory note and land property original document approx value of 60 lakhs in Dec 2015.
As he not returned till now, I deposited the cheques in Feb 2020.
Can i proceed legally criminal case ( NI act), Civil case and cheating case or summary suit to get recovery.
I have taken personal loans from banks and friends and paid him. I am paying EMIs and interests to all still.
Howmuch interest I will get legally.
Yes you can very well proceed against your friend for recovery of your money under negotiable instrument act besides you can also filed a suit for recovery of money as well and also a criminal case for cheating you. But for check bounce case first you need to issue legal notice within 15 days of dishonour of check and subsequently you should file a cheque bounce case within 45 days from the date of issuance of the notice
gud afternoon
yes you can proceed legally...i want to is that cheques got bounce?
you have a promissory note and as well as property papers...in this case first you have to send him a legal notice in that we will give a particular time if he didn't respond then you have right to use that property...
