Cheque And Money Collection Related

I gave 4 lac rs to person in exchange for a signed cheque.. But now he is not giving me money and.. What legal action can be taken if the cheque bounces?

Under Section 138 of the Act, the offence of cheque bounce is a criminal offence for which the payee can initiate a criminal suit. The payee must file the complaint against the cheque bounce before the Magistrate within 30 days of the expiry of 15 days of issuing the cheque bounce notice

you need to first give intimation regarding the amount payable either by sending a demand notice. thereafter deposit the cheque and get it dishonored. once dishonored you need to send a legal notice within 15 days and then file the complaint before the magistrate

You may first send a legal notice within 30 days if the cheque bounces and demand for payment of money. If the person fails to pay the amount after send a legal notice you may file a criminal complaint under Sec 138 of Negotiable Instruments Act. Please Contact for further details.
