Cancelled my booking builder issued cheque but no fund in account

My builder has issued cheques as i have cancelled my allotment of a flat that i had booked 4 years ago as there was no progress in construction. The payment was supposed to be made in 3 cheques one of which is dated 6/6/2016 and 11/7/2016 but the builder keeps on delaying by asking me not to deposite the cheque as there is some issue. I asked a confidant to check the balance in the account from which i am suppose to get my money and the balance is is just around Rs.1 Lac while i am suppose to recover around Rs.50 Lac from the two cheques. What approach can i take?

If you suspect anything fishy, you may deposit the cheques and if they are dishonoured by his Bank you can issue legal notice thru advocate and still if he doesn't pay you file a case u/s 138 of Negotiable Instruments Act. You may also file a civil case for recovery of dues depending on documents and proofs you have with you.

Just deposite a cheque to get cash.
it will be dishonored / bounce.
once cheque is bounced send him a legal notice through lawyer.

Builder will come to you with money.

Remember just one thing A good lawyer for cheque bounce cases will get you to recover your money.
