Can police complaint be filed when no cheque has been bounced

sir my party has file police complaint tell that i had not given him payment but i had cleared 70% pay by cash he is having my cheque with him

There is no question of cheque bounce. He is only having cheque with him. It has to be deposited with the bank. If the cheque is returned by the banker unpaid for the reason 'insufficient funds', then he need to issue you a legal notice for payment of cheque amount within fifteen days. If it is not paid only then it amounts an offence under Negotiable Instruments Act, otherwise not. If you have paid 70 % of the money by cash, then the transaction is still on. You have not refused repayment. You are advised to insist on and obtain receipts for all the amounts you have paid. If he has already given police complaint, then police would call you and enquire about he matter. You then tell them the real facts. I do not foresee any problem for you.

In case you pay by cash always have one witness to testify, hopefully u r having one witness, if so, tell him to tell that you have paid 70% of the cash and he has not deliberately given receipts to defraud you, inturn u shud tell the police to take a compliant on you behalf against the other party.
