Can I file a counter case against 138 NI on poor financial conditions

My mother is getting metally harassed by the financial officer by talking in loud voices and calling again and again by the officer for the repayment of the loan that we have taken and asking for to file case against us.
our financial condition is not good so cheque is been bounce and so the finance officer is giving warning to file a case against us and our condition is not going yet so can we file a case against them? and if we file a case so the cheque bounce case will countinue or not?
