Can a case filed U/s138 and Us/420 be mutually settled.
26-Nov-2023 (In Cheque Bounce Law)
i issued a cheque of Rs. 250,000/- to mr. XYZ and the said cheque was bounced and XYZ made two case U/s 138 and U/s 420. now the 138 case is under evidence and the said ram wants to take cash rs. 200000/- and make mutual settlement with me. what are the legal proceding to be performed that i can relief form him. kindly suggest me. i want to pay the money in installment and Sri XYZ is agree to receive the same within 12 months.
it is not much of a worry which a layman usually thinks off, a memorandum of understanding needs to be made and alongwith it post dated cheques will be given to finish it off at the earliest but before doing all of this the complainant has to withdraw all proceeding against you.
