Bank returned cheque on the basis of insufficient fund

sir mi deposit check in bank and bank return me with memo insufficient fund return date 3/11/2017 one month remaining check expire what can i do

hello Sir/Madam,
1. Cheque has to be presented within 3 months from the date it is drawn.
2. Legal notice to be sent to the person issuing the cheque (accused) within 30 days from the date of dishonour of the cheque.
3. After 15 days of sending legal notice, if person issuing the cheque (accused) does not make the payment, the cheque bounce case has to be filed within 30 days thereafter.
4. Cheque bounce case is filed under section 138 of the Negotiable Instruments Act, 1881 and it will be filed in the jurisdiction where the complainant's (your) bank is situated.

Firstly, if the person issuing the cheque is ready to make payment, then settled it amicably, otherwise take the legal steps.

You must be send legal notice to drawer with in one month ,and after receiving notice to drawer 15 days time to be given for repayment of cheque amount and within one month if drawer is not pay the cheque amount you mast filled complete case under 138 of NI act before Jmfc

You have to deposit the said cheque again in bank because limitation to send notice to other party to demand the amount is lapsed after depositing the said cheque new limitation will starts, after that you can file case under section 138 for dishonor of cheque and you can also file case under section 420 of IPC for cheating simultaneously .
