When Can a magistrate eschew the evidence of bank manager..

if the person who has rendered his evidence affidavit and thereafter refuses to attend court for purpose of cross examination, magistrate can eschew his evidence. but magistrate needs to have compelling reasons (like witness refusing to depose even after issue of NBW) before eschewing evidence
