The bank has issued a remark for a cheque bounced with reasons “stop PaymentBut later when the drawee has enquired on the signature on that cheque , the bank manager gives a letter that the signature on the cheque is mismatch with account holder signatureWill the court proceed the case under stop payment or signature mismatch

Dear Sir, Cheque Bounce case can be filed either on stop payment instruction or mismatch endorsement given by the Bank. In both the cases the drawer of the cheque issued such cheque with malafide intention so that his signature is mismatched with that of specimen signature maintained by the Bank. Hence, cheque bounce case can be filed after issuing legal notice.
