bank has filed a check dishonor case but summons not receive
27-Sep-2024 (In Cheque Bounce Law)
A case has been filed by the bank because of check bounce and case information has been uploaded on Ecourts but I did not receive any summons. Do I still need to appear on hearing date?
Yes...you should appear on the date fixed by the court physically or you can always join through VC. You can also appoint your counsel who can appear on your behalf before the court. If you fail to appear then warrants can also be issued against you. For more legal assistance I am just a call away.
No, you need not to appear before the court unless or until you get summons through the process of court. In some cases where banks go on to file such cases they would let the accused know about the filing of the case in order to expedite their process. However, legally when a case is filed by a party, the other party need not appear before the court unless summons through the process of court are received
