aurthorised Signatory An Employee In Cheque Bounce Case Of A Company

I am an employee , along with CEO signed cheques as I was made signatory by board resolution . Now cheque bounced , matter in court . Now company is also taken in NCLT by another party .apllication is about to be admitted . Now pls tell me what defence i have .. i am extremely worried ..

Since you have recieved the summons from a MM court regarding complaint under section 138 of the Negotiable Instruments Act, you need to appear before the court through your lawyer without fail. After appearance and seeking bail you may apprise the court regarding the true facts. You may contact

You are just a signatory whose job is just to sign the cheques and nothing else. Now if the cheque is bounced with any reasons it’s because there is no funds with the company and you cannot be held liable. You can only be called/summoned by the court to verify if it was your signature or not.

Your question is that you are an employee of the company n company authorised your for signatory of cheque ! Now the opposite party has filed the case at National company law tribunal…! In this situation we need to know details of the notice !N the facts of the case ! Plz b in touch
