Action to be taken for cheque bounce

Hi, I want to know that what legal action can be taken after cheque gets bounced? When can I expect my money will be recovered? And how much time will it take to get my money back? How much will it be charged for this entire process? Thanks in advance for your help

after a cheque is bounced, you have to first issue a notice to the drawer of the cheque within 30 days of the dishonourment of the cheque.. if the drawer of the cheque responds to the notice there are chances you may settle the matter otherwise you should go ahead and file the complaint in thr Magistrates court.

in this case you have to send legal notice under 138 of NI act within one month of return memo in which you have to put demand of your cheque amount to be paid in 15 days
if he fails to do so then you may proceed to file complaint in magistrate court after expiry of fifteen days

as per the judgement of SC the cheque bounce matter supposed to be disposed of within 6mons. the moment cheque get dishonoured you must send demand notice through advocate within 30 days. And about recovery of money it's depends court to court bcz some court works fast. for notice Rs. 5k and for drafting n filing of complaint Rs. 20k
