Accused new address not known to me to give it to court in chq bounce

Filed 138 n.i. case. Summons served. Accused absent. Issued NBW through COP, mysore. Couldnt execute. Police shara was accused changed address 1 year back. Asked judge for issue hand summons. Judge told either to give new address, issue summons rpad or else dismiss. Hence given accused relative address. Sure, they will not receive rpad court summons. Wt to do in next hearing. I'm in blore. Accused mysore. Dont know his new address? Another question is after NBW whether summons can be order? Any options in high court for this case?

1. you may file writ petition in high court against the inspector of police of the station where the warrant is pending for execution.

2. so, the IO take measures to curb the accussed and bring him to the court.

3. you may not get justice in the lower court.

you have to find out the proper address and inform that to court, if NBW issued to accused, he/she might be somewere there only, it's not summons it's NBW only , it will be given to you by hand , receive that and find out the proper address taking assistance of police.
high court is not a option , file application and take paper publication after exhausting all remedies to serve summons, discuss with your lawyer and take necessary action. take steps through jurisdiction police station inspector, it may help you.
