If "Buyer & Debtor" does not make timely payments to "Supplier & Creditor" as per Contract Terms & Conditions and intentionally creates financially critical situation for MSME Supplier. In this situation can "Buyer" blame "Supplier" for Deficiencies or Delays or Breach of Contract during next stage Services, actually due to lack of Funds & Resources available with MSME "Supplier".
No yes it is a Big NO to this question. In contract if there is a clause of timely payment to the supplier from buyer and after seeing inordinate delay in the payment of his pending bills supplier do not supply further goods to him buyer can not blame for deficiency in his services. point of deficiency in service or supply should have been made early withing a readonable time and not after that and it can not be taken as basis of payment delay after a reasonable laps of time. Supplier can go for summery suit to get recover the money on contract basis.
