Unable to pay bank loan and bank harassing my parents for it
14-Jul-2023 (In Banking / Finance Law)
I have taken a loan of 5lacs through hdfc bank. Now they have come to my house where only my parents stay to ask for money. I have lost my job due to life event(divorce) and health issue. Please suggest me a way to get some time till I get a job to pay my loan off.
you can write a legal notice to the bank informing them about the financial condition and giving them assurance of returning the amount and rescheduling the EMI's and the bank can also agree to settle the same
Sir if you had taken loan from the bank then bank officials have no right to harass your parents for that and then still bank officials done the same then your parents have to lodge police complaint against them.
yes you can send legal notice through an advocate regarding same but let me know since when you are in default of payment and how much amount is due to you....in case they do not reply then we can move an application beofore tribunal ...please contact advocate as soon as possible
Hi,
Next time they come to your place, ask for their official ids and take their visiting cards. They cannot harass you although this is a common practice. Make sure you know their names and if they misbehave, say you will contact bank and file their complaint and if necessary will contact police too. Meanwhile Talk to bank representative by going to your branch. Let them know you are in personal difficulty so they dont take coercive action against you. You can further send a nicely drafted letter from a lawyer so they do not harass you.
