What is the time frame to appeal against AFT judgement. Judgement of my case was on April 2024. I come to know about this after 6 months iNow can i appeal against verdict in NANA case
Appeal against AFT judgment lies only to the Hon’ble Supreme Court under Section 30 of the Armed Forces Tribunal Act within 90 days from the date of judgment or knowledge. If you came to know after 6 months, you can still file appeal with an application for condonation of delay by showing sufficient and genuine reasons. There is no appeal before any High Court. Further remedy is only by Special Leave Petition before Supreme Court.
Under Section 30 of the Armed Forces Tribunal Act, an appeal to the Supreme Court lies within 90 days from the AFT judgment. Delay can be condoned on sufficient cause. If you learnt of the April 2024 judgment after 6 months, you may still seek condonation and challenge the NANA (Neither Attributable not Aggravated) finding.
