"Need Lawyer for Appeal & Stay on Salary Deductions"
26-Aug-2025 (In Arbitration Law)
I am a government school teacher earning ₹1,17,320 gross and ₹45,388 in-hand. ₹52,500 is already deducted monthly, and an Arbitrator of Delhi Cooperative Bank imposed a ₹20,000 lien, leaving me only ₹25,000. Out of this, ₹21,000 goes to rent, so I survive on ₹4,000. Two more deductions of ₹12,000 and ₹10,000 may start, making it ₹74,500. Under Section 60 CPC, only ₹14,800 is attachable. I need a lawyer to file appeal & interim stay before Delhi Cooperative Tribunal. At present, I cannot pay any fee, but after lien removal I can give ₹10,000 token, and once the case is resolved, I will pay one month salary (more than ₹1,00,000) as fees.
In your case, the deductions being made by the bank are clearly excessive and go beyond what is legally permissible under Section 60 CPC, which protects a substantial portion of your salary from attachment. The most effective step for you right now is to file an appeal before the Delhi Cooperative Tribunal against the Arbitrator’s order and simultaneously seek an interim stay to immediately halt the lien and further deductions; while doing so, you should present your salary slips, bank statements, rent agreement, and details of your family expenses to establish the hardship being caused. Alongside this, a legal notice will be issued to the bank pointing out the illegality of its actions and warning it to withdraw the unlawful deductions, and if urgent relief is still required, we can also approach the Civil Court under Section 9 of the Arbitration and Conciliation Act to secure protection of your salary.
Hi there, i can file the appeal before the tribunal but for that I will need more details of the arbitration between you and the bank and the details of the lien.
Based on which we can devise the proper way to get you relief.
It's advisable to contact me and provide more details to assist you better.
Your case has strong merit under Section 60 CPC, which limits attachment from salary to only a portion, protecting your subsistence. The arbitrator’s lien of ₹20,000 appears excessive and can be challenged before the Delhi Cooperative Tribunal. We can immediately file an appeal and seek an interim stay to stop these deductions. Once the lien is stayed, you will regain financial breathing space. I understand your current hardship and am willing to proceed with a structured fee arrangement, with a token at interim relief and balance after resolution. Let’s take urgent legal steps to safeguard your salary rights.
