Questions Answered by Advocate Abhyuday Mishra (25+ answers)

Q: "Need Lawyer for Appeal & Stay on Salary Deductions"

I am a government school teacher earning ₹1,17,320 gross and ₹45,388 in-hand. ₹52,500 is already deducted monthly, and an Arbitrator of Delhi Cooperative Bank imposed a ₹20,000 lien, leaving me only ₹25,000. Out of this, ₹21,000 goes to rent, so I survive on ₹4,000. Two more deductions of ₹12,000 and ₹10,000 may start, making it ₹74,500. Under Section 60 CPC, only ₹14,800 is attachable. I need a lawyer to file appeal & interim stay before Delhi Cooperative Tribunal. At present, I cannot pay any fee, but after lien removal I can give ₹10,000 token, and once the case is resolved, I will pay one month salary (more than ₹1,00,000) as fees.

Advocate Abhyuday Mishra answered
If in this case the lien arises from an arbitral award, then you can file a Section 34 challenge (within limitation) with a Section 36(2) and (3) stay application; if under the DCS regime, file the statutory appeal/revision and seek a stay.
