Arbitration for refund of fees paid to IGNCA, Delhi how to proceed

I joined a one year PG diploma course in Cultural Informatics at India Gandhi National Center for the Arts, ND. For this I paid fees in advance for one semester at enrollment. I attended a class each of all the modules in the semester. I was not satisfied with the way the course was being conducted and with the delivery. I consulted the Acedemic head and decided to discontinue. However, they are refusing to give me a refund of the fee. Kindly, let me know if it is possible and worth trying? It will be great help. When it comes to the refund of tuition fees paid to the institution it's possibility is totally dependant upon the prospectus and the rule book which they have with themselves which was signed by you at the time of taking the admission.
Academic affairs are completely governed by the contract made in between the institution and the student. If there is a scope of refund even after attending the institution for one whole semester then you will get your refund else no.

Dear concerned
It is tlworthless to try for refund as u think it is waste of time behind this until unless u get any milestone judgement for the same.In normal case institute never ret urn the paid fee but exceptions are different.
If cost of visit is less than the amount paid in total than can try to get refund.

The presence of the aribitral clause will determine if the matter is to be sent to arbitration or not. Prima facie it appears you may have a case, however, the documents as well as the rules of the University would have to examined to determine the feasibility of your claim.

Although it is difficult to get your fees refunded provided there is no express clause in the brochure or prospectus specifying of denial of fees once paid is non-refundable but on serving a legal notice, the same can be tried once.

Firstly, at the time of the admission in the course there must be some kind of agreement or paper work that you must have signed or a copy of the same must have been provided to you.
The formalities with regard to the refund of the course fees is generally dealt in the said agreement or receipt which you receive at the time of deposit of fees.

If there is nothing written on refund of fee, the recourse can be consumer forum and not arbitration. Because to initiate an arbitration proceeding, there must be a clause for arbitration in case of any dispute and that arbitration cannot be initiated unilaterally without having an arbitration clause in the agreement.

Secondly, Arbitration proceeding are a bit costly and to claim a refund of fee I do not suggest arbitration would be a right forum. So, in my opinion first step should be to send a legal notice to claim the refund and even then if there is no response from the Institute, then we can approach consumer form to claim the refund and damages.
