One of my relatives who is on bail wants to go abroad on holidays

24-Jan-2023 (In Anticipatory Bail Law)
My relative is facing criminal charges in court of law. his anticipatory bail is converted in to regular bail in the year 2013. Charge Sheet has been framed but trial is yet to begin. He wants to go to USA with his wife for 6 months to look after his daughter who is expected to deliver a baby in a month. There is no body else in her family to take care of her. Can we request the permission of court for leave of absence for 6 months

Dear Sir Yes, an application to be filed seeking such permission. If charges are not framed then it will be easier orelse you may have to approach High Court. If charges are not framed discharge application may be filed. It bettet to send entire copy of charge sheet to get more guidance on how to cross examine the witnesses.

Yes, but the probability of it depends upon the gravity of the charges and the conditions given in the bail order. Definitely you can approach the same court and can appeal if refused to in higher courts.
