Can police or court seize the residence of the accused is non bailable arrest warrant has been issued? How many days does court to appear in the court ?
law is very clear on appearance in a criminal court first Saman is issued if the person does not turn up on someone then bailable warrant is issued and taking that bailable warrant one can appear in the court is that there's no harm once the person does not appear on the bailable warrant and seek bail from the court there after non bailable warrant is issued by the learner 84 even after issuance of non bailable warrant the accused person does not appear then the police or investigating team get an order from the court to search the person and then procedure of Section 82 and 83 of CrPC is is put into motion that is known as attachment by narration of the facts bayou it appears that non bailable warrant has not been issued therefore the attachment stage has not yet come
Hi,
Going by the limited facts provided by you,
If the offence is bailable or non bailable the Police Officials have to take the person before the Magistrate within 24 hours if the arrest.
If the same is not done by the Police Official then one can move against the Police Official in the Court.
