Q: What happens if the victim dies before trial? What will be the status of that case?

Hello Sir/Madam, I want to know what happens if the victim dies before trial. In a rape case, if the victim dies due to an accident or any other reason after the case is prosecuting but before it is final, what will be the status of that case? Please reply.

you should first of all clarify whether you are from victim side for the complainant side secondly e the criminal case if the FIR is filed it is case against the public at large which is known as in rem this is a legal term death of victim does not dilute the criminal law and the criminal charges levelled against an accused the point is if the victim is death that can be e understood that the vital witness of the case is dead but if statement of victim has been recorded under section 161 of CrPC or 164 of CrPC before the magistrate for the victim has the posed as witness in the court in a trial these are three different stages you should clarify and refine your question to get an appropriate answer I hope this should have clarified your question still you feel that you need more clarification kindly come up with more facts and precisely to the points so that you may be given proper advice

Q: Non bailable warrant when Anticipatory Bail is pending.

Police have framed My Uncle in one criminal case with section 120B. The court have issued summon and thereafter Bailable warrant and fix the hearing on 24.05.2021. After noticing the same, My Uncle applied for the Anticipatory bail which was pending before the same Judge(ADJ) and to be decided on 25.05.2021.But before deciding the said Anticipatory bail, the Judge issued NBW on 24.05.2021.Is it appropriate in Law to issue NBW when Anticipatory Bail is pending ???I am thinking of going to Delhi High Court ..

yes you shouldhighly improper.your Identity and pretence is there . therefore the ld judge had every occasion to get your identity very died and matched and could issue a summon only If your presence is not marked .

you can file counter case or true case what ever you call it firstly in nearest or local police station if the police station is not ready to lodge the FIR THEN you can file complaint before the majistrate court, or you may also opt for filling writ petition in High Court.

Dear Team,I have unsecured debts of more than 20 Lakhs of 12 credit cards and 8 personal loans. Now i am unable to pay these huge amount as i have lost around 13 lakhs in stock trading.I am salaried individual with salary of 20800 only which is only my fixed income soure and also i have no asset or property on my name. As in these difficult situation i am not seeing any way to pay this amount and creditors continously calling me and visiting office and home for payments and a going thorugh mental harassment.For this i am thinking to file bankruptcy so please consult me how to file bankrupcty for salary individual with no asset?And after convicted bankrupt can i started my life noramlly as a salaried person?

it appears that you want to know that punish of subsequent case will be concurrent or Consecutive?it india the courts use ther discretion in awarding the punishment/ sentenceit may be adjusted or in addition todepending on the order of the Hon./ Ld Court.
