Q: Need help regarding the landlord - tenant issue

Hi, There is a property of around 450 GAJ in North delhi near " Roshanara road " and this is a katra or chawl . So , we lived there for more than 40 years and not living from past 10 years but we do visit that property once in a while . So the thing is that family who claimed to be a landlord of this property are planning to sell this entire property to a builder. And the fact is that they don't have any legal papers of that and they want us to leave our house so when we told them to sell " our part " to us they denied and respond that they don't have any authority to do that and they indirectly saying that if you don't do that you will see us in court . My questions is that is he right ? And if we go to court there are any chances to win over and if we go to other alternative which is leaving that house in change of money will be a valid move ? Quick response would be much appreciated!Thank you.

Advocate Sunil Kumar Singh answered
it appears that you claim the property on the basis of your prolonged possession.you are admitting the fact there are landlord s of this property. you donot know actual basis and proof of there claim.as well you do mot have ownership.adverse possession is your case.it is for you to decide as to whether you want long drawn litigation or amicable settlement. you have t whiegh the offer and your convenience.if you get good amount you can compensate your loss of possession.

Q: leasing of property after demise of landlord

Dear Sir/Madam, A commercial property in Delhi owned by Father and Son and after demise of Father, can the son lease the property even if the property is still in the joint name of father and son. Can he lease before transfer of property in his name?

Advocate Sunil Kumar Singh answered
one can not transfer or sell or lease more than what he has the son can leas his part of the property and after the death of his father if the father died intestate then the property would be succeeded acording to the succession chart / rule of the religion of deceased landlord. if the deaseasd landlord died after writing will in favour of son for the rest part/ portion of the shop to be leased then the sun has to get a succession certificate and then only the son can let out the other part / portion.
