Q: Legal remedy for arbitrary rejection of assignments

I submitted 37 IGNOU assignments on Oct 11, 2025; only 22 were processed and 15 are missing. I have signed receipts, verified documents, transfer proof, video evidence, and PDF backups. The Study Centre claims rejection without proof and asked me to resubmit. What is the most effective legal path to compel evaluation—iGRAM/CPGRAMS, RTI, legal notice, or Writ Petition?

Advocate Yuvraj Gulia answered
You have strong documentary evidence, which puts you in a favorable legal position. The most effective approach is to proceed in a structured manner rather than directly filing a writ at the outset.Firstly, file a detailed grievance on iGRAM/CPGRAMS against IGNOU and the concerned Study Centre, attaching all proofs (receipts, video evidence, PDFs, etc.). This creates an official record and often leads to quicker administrative resolution.Simultaneously, file an RTI application seeking:Status of all 37 assignmentsReasons for non-evaluation/rejection of 15 assignmentsNames/designation of अधिकारियों responsibleThis will help establish accountability. If no satisfactory response is received, send a legal notice to IGNOU and the Study Centre demanding evaluation of pending assignments within a stipulated time.As a final step, you may file a Writ Petition before the High Court under Article 226 seeking directions for evaluation and protection of your academic rights, especially since arbitrary rejection without proof violates principles of natural justice.Given your evidence, your case is strong and courts generally take such academic negligence seriously.

Q: Fraud lawyers took money and blocked me

Fraud lawyers Niraj madan and Naresh madan took 50k from me and blocked me for case 376. I'm victim. What can I do to get my money back. They are not responding for refund.

Advocate Yuvraj Gulia answered
You appear to be a victim of cheating and breach of trust. If the advocates have taken money and failed to provide services or have blocked you, legal action can be initiated.Firstly, collect all evidence such as payment receipts, bank statements, chats, call records, and any agreement or case-related documents. These will be crucial. You may take the following steps:File a criminal complaint/FIR under Sections 406 (criminal breach of trust) and 420 (cheating) of IPC at your local police station or through online cybercrime portal if payment was digital.File a complaint before the State Bar Council against the concerned advocates for professional misconduct.Send a legal notice demanding refund of your money within a stipulated time. You can also file a civil suit for recovery of money along with interest and damages. If your case (case 376 as mentioned) was not properly handled, that further strengthens your case against them.Act promptly to protect your rights and ensure recovery.

Q: Refund of admission fee in case of ward not joining institution

How much of admission fee shall i get back when i have informed the school even before session begin, that my ward wont be able to join school due to relocation

Advocate Yuvraj Gulia answered
You are entitled to claim a refund, but the exact amount depends on the school’s refund policy and applicable guidelines. As per general legal principles and various court/consumer forum rulings, if you informed the school before the academic session commenced and the seat could be filled by another student, the school cannot unjustly retain the entire fee. In such cases, they may deduct only reasonable administrative charges.Further, many education boards (like CBSE) provide that tuition fee for the period not attended should not be charged, and caution money/security deposit must be refunded. If the school refuses refund without valid justification, it may amount to unfair trade practice, and you can file a complaint before the Consumer Commission seeking refund along with compensation. However, if there is a signed agreement clearly stating “non-refundable admission fee,” courts sometimes allow limited deductions, but not arbitrary retention of the full amount. You should:Check the school’s written fee/refund policySend a written request/email for refundIf denied, issue a legal notice and proceed legallyOverall, you can reasonably expect a substantial refund, subject to minor deductions, especially since withdrawal was before the session started.

Q: Loss of buisness data

I was running a Bajaj two-wheeler sales showroom until 2021, after which I closed the business. In July 2021, I sold a new bike to a customer and took an old motorcycle in exchange. Later, that exchanged motorcycle was sold to another person. However, after closing the showroom, the register and records related to that transaction were lost. At present, I do not have any legal or non-legal documents or details of the person to whom the old motorcycle was sold. Now the registered owner of that motorcycle is asking me for the buyer’s details and is threatening to take legal action against me.He needs some legal documents from my side .

Advocate Yuvraj Gulia answered
If you had sold the exchanged motorcycle to another person but the records have been lost after closing the showroom, you should first explain the situation in writing to the registered owner. Liability generally remains with the person in whose name the vehicle is registered until the ownership is formally transferred in the RTO records. You may file a general diary or police complaint regarding the loss of records and attempt to trace the transfer through RTO records if available. Provide any available information about the transaction. If legal action is threatened, you may respond through a legal notice clarifying that the vehicle was sold and that the records were lost after closure of the business.

Q: About emi due and cheque bounce

Hello I have two loans account with electronica finance and i am not able to paid dues on time and i have loan with family members and in December I got a message that loan account company issue a cheque but cheque return due to account block of my Mom account, but I don't receive any notice till now but today they send me notice in which date of August and October not cheque bounce notice I received and they said we issue a warrant if u not paid three emi in next three days

Advocate Yuvraj Gulia answered
Even if a cheque was given as security, if it has been presented and returned unpaid, the lender may attempt to initiate proceedings under the Negotiable Instruments Act. However, they must follow proper legal procedure including issuance of a valid legal notice within the prescribed time period. A warrant cannot be issued directly without filing a complaint before the court. If you are receiving threatening or harassing calls, you may document the communications and respond through a legal reply to the notice. It is advisable to review the loan agreement and explore settlement or repayment options to avoid further legal complications.
