Advocate Yogesh Dutt Sharma answered
If you gave the cheque with the purposes of security then you should prove that the cheque was given as security if it will prove then no complaint is maintanble against you.Secondly you have to prove that the said amount was given to such other party after or before the legal notice which was sent by such other party to you regarding cheque bounce complaint. Its a legal process should take time you have to find a experienced lawyer for that and should contest the case properly.

Q: Declared proclaimed offender cheque bounce case.

I missed court notices on cheque bounce case due to address change. And was declared proclaimed offender 4 days back. When I came to know I paid the Complainant. He is ready to withdraw case. What documents I need from court to avoid any future problems. Do I need to go to court or mere withdrawal from complainant lawyer will be sufficient. Thanks in advance

Advocate Yogesh Dutt Sharma answered
If the opposite party willing to withdraw their complaint then you should attend the court with them and with your lawyer and give the submission that you haven't receive any notice and you are willing to pay all dues. After that the opposite party withdraw their complaint and you should pay the amount in front of court. After the withdrawal statement of complainant the case will dispose off and you are free from all the obligations.
