Q: Need to understand if this can case can be quashed
There is FIR filed against me for a email sent to financial stakeholders for malicious practice happened in the firm so I have been charged as cheating and breach of contract .financial loss. i have sent this email post I left the company..there is charge sheet being submitted in the court ..
Advocate Vyankatesh Pandey answered
Since the alleged email was sent after your resignation, the matter will primarily depend on the contents of the email, your intention, the circumstances in which it was sent, and the specific provisions invoked in the FIR/charge-sheet. Mere sending of an email or causing financial loss does not, by itself, establish cheating or breach of contract; the prosecution must satisfy the ingredients of the specific offences alleged. You should immediately obtain and examine the FIR, charge-sheet, employment agreement, relevant correspondence and the complete email trail. If the allegations even on their face do not disclose the essential ingredients of the offences, appropriate proceedings for quashing may be considered before the High Court. If the charge-sheet has already been filed, the defence can also be raised at the stage of discharge/framing of charge, depending upon the offences and the court concerned. Do not delete or alter any electronic communication, as the complete context may be important to your defence. further you can contact me anytime whenever needed sir I'm always there happy to help take care thank you
Q: cc case 319 crpc detailed answer required interested answer
When Crl.M.P. of 2026 filed under Section 319 Cr.P.C. has remained pending for respondent-side arguments/enquiry since may 2026 and has been repeatedly adjourned at the request of the respondent side, while the main C.C. case of 2021 has itself been pending since the year 2021, whether the proceedings can be permitted to remain indefinitely pending by repeated adjournments, or filing 309 crpc in next hearing in the interest of expeditious disposal and in accordance with Section 309 Cr.P.C.
Advocate Vyankatesh Pandey answered
Section 309 Cr.P.C. squarely empowers the Court to regulate adjournments and ensure expeditious progress of an inquiry or trial. Repeated adjournments at the instance of the respondent, particularly when the main C.C. case has been pending since 2021 and the Section 319 Cr.P.C. application has remained pending since May 2026, cannot be allowed to defeat the object of a speedy trial. The Supreme Court has repeatedly deprecated adjournments granted merely on the asking of a party and has emphasised that reasons must be recorded for postponement. Therefore, at the next hearing, you may file an application under Section 309 Cr.P.C. seeking expeditious disposal of the pending Section 319 application and requesting that no further unnecessary adjournment be granted. You may also request the Court to fix a short date and decide the Section 319 application before proceeding further with the trial, as applicable. further you can contact me anytime whenever needed I am always there happy to help take care
