Q: Money recovery suit based on dishonored cheques filed under Cpc
Principal(Drawer) gave signed blank cheques to agent (drawer) to withdraw funds from principal bank account. Agent used many cheques and withdrew funds for agreed purpose. Unused cheques are with agent not returned to principal. Out of unused cheques, agent misused two cheques , filled amount, date&payee on his own without principal consent, sent for collection, got dishonored for lack of funds. Agent filed civil suit under Cpc based on dishonored cheques. are these cheques void u/s.87 of ni act.
Advocate Vivekanandan A answered
no you have to contest the case is any proceeding taken up by the principal as against his agent you have valid case i need to clearly one thing whom against the dishounour of cheques is filed ?if agent filed a civil suit against the principal it has to be decided by the court and evindence to show he is only agent to act on behalf of the principal and breached the principal agent relation if the case is against the third person then the third person has to bring the principal to prove his case
