Cancellation of an illegal subdivision in patta arises when a land record has been altered without lawful authority, proper title, or due procedure. In Tamil Nadu, patta is only a revenue record reflecting possession and does not confer ownership, yet an unlawful subdivision can adversely affect property rights. Such subdivision can be challenged on grounds including lack of title of the person who obtained it, absence of consent from co-owners in joint property, violation of natural justice (such as no notice being issued), or fraud and misrepresentation. The aggrieved party should first approach the Tahsildar by filing a detailed petition for cancellation, enclosing relevant documents like sale deed, parent documents, previous patta, encumbrance certificate, and proof of possession. If relief is not granted, appeal lies before the Revenue Divisional Officer, followed by revision before the District Revenue Officer or District Collector. Where title dispute is involved, a civil suit for declaration and injunction under the Specific Relief Act, 1963 is the appropriate remedy.
