Q: GPA without a legal heir's signature, was used to sell property valid?
Dear Sir/,madam,nThe GPA was executed which included several rights including sale of property in HOSUR Tamil Nadu. The property was inherited from grandfather who passed away without any will. He had only one child and 4 grand daughters. One of the grand-daughters has not signed the GPA. Furthermore, this GPA was used to execute the sale deed without the consent of the people who had signed the GPA (3 grand daughters and daughter). Now that one of the Grand-Daughters has not signed the GPA, is the GPA valid? also, is the sale deed that was executed using this GPA valid?nnPlease enlighten

If all 3 who have given GPA to one person GPA is valid and if they gave right to sell to that person and registered the GPA .. that GPA holder has right to sell for only those 3 peoples share if one person is missing them 4th person should be party to the sale deed … if that 4th person was not made as party than she can claim her rights ..
Q: GPA given to someone by previous owner of property is sale valid
Sir, We have purchased the 1 acre of land Jun-2016 and we have title deeds for this property and Khatha(RTC) after the purchase.Last month We came to know that the previous owner of this property had done GPA to another person in the year 2007 but the GPA holder was died on july-2016(One month after our property got registered).We came to know about this GPA last month from GPA holder's family member. So please let us know 1.what is our rights of legal holding for this property. 2.How can we proceed with any legal action . 3.What is the power of the GPA holding as the person died already.

Hi, Few points to be note1. Is that GPA is registered?2 is that GPA contains the clues of Right to sell the property ?3 did you purchased property from the owner or from his family members ? And did you registered it?If the present owners execute registered sale deed in your name than you have complete title over the property. And if anyone files any legal action, then you can provide sale deed And other property documents which are in your name like khata, RTC, EC and registered sale deed... There will be no value for GPA after the death of. GPA holder .
Q: Other people preventing me from constructing a house on my site
i have a site and some 3rd parties are coming and preventing me from constructing a house on y site on the ground that the property belongs to them. Yes, you can file case against those people, who are illegally encroaching to your property, people who enter to your property without your permission are called as trespasser, you can file FIR to police station (concerned jurisdiction), and you can file Civil Suit for permanent Injection to restraining them from entering to premise.

I hope you have 2 queries..1)Yes you can gift your property to your mother's name and you can register said Gift Deed, but the property shall be self acquired property, and you should be the sole owner of that property and there shall not be any mortgage or loan for the said property.2) yes, you can enter in to Agreement called "Memorandum of understanding" stating that you are taking loan from your father and you will pay monthly EMI to his Account.
Q: Landlord allows a family to stay for free after we paid one month rent
We recently vacated our flat in white field. The landlord took one month rent n maintenance and agreed to refund if she found a tenant soon. We found out thru our maid that someone were living in our flat and when asked of landlord , she mentioned that it was for free and tenancy would start from augustv1st. Is it correct? Shouldn't we be getting our partial rent refund.
