My husband has been torturing me mentally and physically on various occasions since the birth of our child who is now 3.5 years of age. Every two months he asks me to bring money from my parents house and will not let me take my child along with me so that I will bring him the money for sure. I want a divorce and child custody based on the current scenario.

you will have to file a contested divorce case against your husband along with a criminal case under domestic violence act, and under IPC 498A .meanwhile you can file a maintenance case against your husband under sec 125 Criminal procedure code for maintenance of you as well as your child .your husband will be bound to pay the maintenance or else he will have to go to prison.

file a money execution case against the husband attaching the interim order given by Judge. husband will be directed by the judge to pay the maintenance , if then also he didn't appear or pay the maintenance then judge will issue a distress warrant against husband directing the officer in charge of nearest police station to arrest the person/husband.
