Q: How can i marry my girlfriend if parents are not agreeing ?

I and my girlfriend are in relationship since last 5 years but our family does not agree on marriage. we both trying to convenience our family. In last 6 months all things changed drastically. our families and relatives created various miscommunication between us. as a result we had a fight and did not talked for 2 months and suddenly i got to know that she got married in april 2017. Last week we had a talk again and surprisingly she was asking me about hows my marriage and we got to know that someone created big gap between us and she got trap. Now we both want to marry by anyhow. i know it looks like silly question, how this could be happen but this really happen to us. pls guide what are the option available to us??

As per Hindu Law Second Marriage is void/illegal. So your friend need to take divorce from her husband to get married to you. After that you can get married to your friend in court. Only 2 witnesses are required for marriage through court. Any of yoour close friend can bacome witnesses to marriage. For futher help meet me at my chamber.

Q: Threatening of Criminal Case by Company when I asked for salary

Dear Sir/Madam I was an HR with the company. As the salary was low i resigned. later on i took up a job in another company after 2 months. As a wish to get a higher salary, i made appointment letter with wrong designation, higher salary and wrong tenure. while having a background check, it got negative. As a result i have been terminated without any compensation. The chapter closed. Now when i asked for the salary for the day till termination, the second company is saying "you have came with cheating intention. your past company is going to take criminal action on forgery and we will be helping them to file criminal case against you." I am a family man Sir. I have left the job that was taken against false documents. I am very poor and i did this just to get a high salary. This has resulted in loss of job. Neither i cheated any big amount of both the company. I am clueless and i need advice as in what needs to be done. They are continuously threatening me.

Though you've committed forgery and its a serial criminal offence. It is punishable offence as per Section 465 of Indian Penal Code for which imprisonment is upto 2 years. Now the further question arises wheather the documents were signed using digital signature or pen? Please provide further details so that we can help you out.

Q: Bought Car through dealer. I am in legal trouble. What to do ?

I brought the car from the dealer of 1lakh and decided to follow with agreement but with cleverness he took the money and told every week or month come after few days I will do that but he didn't. He has my 5 cheques and he did not give my salary for 4 months I am continuing going there but he is not there after long time he called me up for demanding 1lakh for car but I told him I don't have so he told me OK else take or give you a call I told you give me but after 3 months he did not give me what to do sir go to police station and right to the complan against him or what to do I am very depressed

Please dont be depressed, it wont help you. Write a complain on white paper to the SHO of the of the police station narrating everything along with the cheque numbers and give this complaint to the nearby police station and take an acknowledgement copy from the police station. Please retain this copy with yourself to save yourself from future legal trouble.

Q: Property dispute among siblings what to do

My grandfather made a will before dying that each of his two sons(Inc my father) will have one plot each in delhi. Now my father's youngest sister(among 4sisters) filed a case against my father asking for her share in property. She is currently working in a hospital as nurse and married and has two children. What are the chances of me and my father winning this case? (Hindu by religion)

Since your grand father died testate and he has bequeth property in the name of his sons i.e your father and your uncle(chacha/tau); No claim can be raised by your father's younger sister. Share in the property can only be claimed if the wordings of the will are not clear which indicates how property is to be distributed. For that we need to see the will then only we can help you with your case.

Q: Dispute of the terrace property on builder floor

I purchased a builder floor and currently living on the upper ground floor in New Delhi . My water tank is on the terrace but unfortunately the top floor owner says he has purchased the terrace. He locks the terrace and everything on the terrace is in his control!! If I need access to the roof every time I need to literally request the top floor to allow me. He had made arrangements and I suspect he uses water from our water tank,emptying it everyday. What is the law? What can be done? I'm 60 years old and if there is any senior citizen helpline kindly guide me.

Respected Sir,First we need to ascetain that wheather the roof rights are common or it has been sold to the person you have mentioned. In case roof rights are common then he can be restrained from locking the passage to roof. You have equal right to access roof since your water tank is already on the roof. In this case the other person either he sould give a duplicate keys or he shoulf provide you free access to roof.
