Q: Limitation to challenge registered partition deed ?
Our Family executed a Partition deed between 4 brothers in 1999.Of the 4 parts, 2 brothers were given 1 share each and the 2 shares were clubbed together and allocated to the remaining 2 brothers because one of the person was disabled and the other brother was looking after this disabled bachelor brother. Now the remaining 2 brothers are claiming 1/3 of share from the disabled brother's share since he did not execute any will to the brother who looked after him. The case has been filed after 12 years the partition was executed. can registered partition deed be challenged ?

the case is well within the limitation of partition. but you can contest and get it in your favour as the demands made by the other 2 brothers is un reasonable. hence i suggest you contest the case and on ur behalf of the disabled brother

I suggest you take the 498a case to trial and chargesheet. and the case will start. also mention about the property in DV and dowry case basis this you will be able to get a good relief. Also make sure that his parents are also involved in the DV case.
Q: Plz help me regarding my 406 stidhan case...
Husband filed divorce on cruelty. During counseling, He told that he will return my stridhan iff I agreed for MCD & before signing papers he will bring my stridhan in mediation center for verification. He also told me that he had kept my stridhan in someone else home whom I don’t know. I have only photos & bills of my stridhan, however I don’t have any proof that my stridhan is lying under his possession. My lawyer asked me to file 406 cases against him & to get search warrant to recover my stridhan. But even if I get search warrant, Police won’t be able to find anything in his home as he has already moved my stridhan in another person’s home. Is it possible to get a search warrant to seize my stridhan from the premises of the mediation center of court at the time my husband brings it there for verification purpose? If yes, what steps should I take so that the Court won’t give any prior notice or summon to my husband about the search warrant else he won't bring it in mediation center?
