Q: Procedure to get GST number for the shop

My father left a business garment and cloth shop for me .I want to take a gst no for the shop .So what should I have to do to get gst no.

GST Range, Circle and Sector, etc shall be determined on the basis of previously applicable VAT and Service Tax Rules, hence, it is actually advisable that please refer to some recognized professional and thereby, proceed further under his/her guidance.

Q: Format of NOC from owner as proof of address of business place

I have applied for gst registration for a new proprietary firm.address proof of business place of firm is in name of father. Query raised from Deptt to produce noc from owner.what is the format for this noc and does it require to be on stamp paper and notarised.

NOC for GST registration is the basic Form of No Objection Certificate, to be issued in the name of your father stating that he does not have any objection in you carrying out your business activities at the address owned by him. Further, this NOC has to be printed on a 10 Rs. stamp paper and need not to be notarized.

Q: Who is the authority to decide my turnover comes under GST list

Iam from a small city of u.p named Fatehpur.Recently 2month ago i have started a retail cloth store.please tell me,am i require to register under gst? who will decide that my turnover is less than 20lakh ?

There is no authority required. Your books of accounts (which obviously will be prepared by your accountant) will state that whetger your turnover is less than 20 lakh or not. Further, if it is more than 20 then yes you need to get registered under GST.

Q: Procedure for execution of Unregistered will and property division

My father expired n left a self acquired property. I,My mother n my sister are class 1 legal heirs.We hv obtained legal heir certificate.He left an unregistered will.In his will he has given a part of the property to his brother n other part in my mothers name.Pls advise if this will is valid..properly signed by witness but unregistered. Pls guide how this will be executed,steps involved to transfer the property between his brother n my mother.Property is in U.P.

An unregistered will is valid if it conforms to legal requirement of two witnesses who have signed the will in the presence of the testator and the testator has signed the will in their presence. The primary aspect of a WILL to be legally valid is 2 persons attesting witness to the will when the testator signs in their presence. When only one person has signed as witness then it is not a valid Will. Will need not be registered.
