Q: Criminal Revision dismissed in high court
Criminal Revision was files in high court against the judgment passed by district and session court of conviction and senetence for 3 years and 3000 rs fine under offences u/s 387 I.P.C. No lawyer could appeared from appellant as did not get the notice for case listing ( actual reasons unknown) and high court has dismissed the revision petition saying As this matter is pending since the year 2008, the same is being disposed of based on the materials available on record. It has been more than an year now. What all options are left with appellant?
Advocate Ujjaval Kumar answered
Section 387 of the Indian Penal Code basically deals with putting person in fear of death or of grievous hurt, in order to commit extortion. There are 2 possibilities in this case: 1. We can either file an restoration application at the High Court itself. or2. We can file a Special leave Petition at the Supreme Court against the order passed by the High Court
Q: False Molestation Accusation by woman
Hi,I went on a date with a girl from a dating app 6-7 months back. We met once and I didnt meet her again because we didnt connect and we had nothing in common. We went out for dinner once. There was no communication at all for 6-7 months.Suddenly after 7 months I get a message from her on facebook first asking saying Hi and asking me if i was single or not. Then suddenly she starts saying that I forcefully kissed her and touched her, which is not true. We just met once and didnt meet again and neither did any of this happen. I denied all of this on the chat too and asked her if she messaged the wrong person. I also asked her why she is messaging me all thisAfter the incident there were no phone calls or messages or any communicationCan i legally be in any trouble. Can she file a complaint. I am worried. Thanks
Advocate Ujjaval Kumar answered
You should keep a proof of the chats and any evidence of meeting her.Yes she can definitely file an FIR undet section 354 or 376, 504 or complaint at the women cell.We can file a quashing petition at the High Court for quashing the false complaint.
Q: Special leave petition in supreme court
It is made clear that no request for further adjournment, at the instance of any party, will be entertained on future date.
Advocate Ujjaval Kumar answered
Hi,It basically means that you cannot seek a further date on the next date of hearing on any ground whatsover. You have to comply with the previous order/ directions of the Hon'ble Supreme Court whether it's filing of counter affidavit/ rejoinder or curing defects if it is before the Chamber Judge. If your matter is kept for final arguments, then your counsel needs to do the same on that date and cannot seek further adjournment.hope this will help.regards
