Does a legal heir can claim right on property which the deceased person havent claimed during his/ her lifetime? Means a person doesn't claim his right on property and passed away now his legal heirs can claim on tht property tht they have share in tht property..

Yes, legal heirs can claim a right on a property that the deceased person had a share in—even if that person did not assert or claim it during their lifetime, provided the right was still legally valid and subsisting at the time of their death.
Q: Fraud Sale Deed: Buyer Registered Despite Valid Prior Agreement
We seek urgent guidance from experienced lawyers regarding a property fraud matter. Our Sale Deed (No. 7932) was fraudulently withdrawn using a forged signature, even though our valid Agreement to Sell was active. On the same day (30.06.2023), another Sale Deed (No. 7931) was registered in favor of subsequent buyers, who had no valid sale agreement. The Sub-Registrar concealed the forged withdrawal for over 15 months, ignored DORIS dispute status, and processed the registry despite our formal objections. Our lawyer claims the buyers are innocent as they “paid and took possession.” However, FSL confirmed the forgery. We seek advice on: (1) Can such buyers still be held liable? (2) Are there any court rulings penalizing such buyers? Kindly help with case strategy or precedents.
Advocate Udesh Puri answered
1. File a Civil Suit • Reliefs to Seek: • Declaration that Sale Deed No. 7931 is void.2. 2. File a Criminal Complaint / FIR • Cheating • Forgery & use of forged documents • Criminal Conspiracy • For misconduct and dereliction of duty by public servantIf property possession or transfer is still in process, move for a temporary injunction under Order 39 CPC to protect your interest.
Q: Property in municipality case in EWS certificate
Sir kripya ye bataye zameen jispe muqadama chal rha kya wo ews criteria me joda jayegaBainama ki zameen pe bhi muqadama haiKripya jawab de
Advocate Udesh Puri answered
Sir,If the land in question is under litigation — whether it’s land acquired through a bainama (registered sale deed) or otherwise — it cannot be included under the EWS (Economically Weaker Section) criteria until the dispute is resolved and clear ownership is established.To include any land under EWS category, the following conditions must be met: 1. The land must be free from any legal dispute or litigation. 2. Clear and undisputed ownership should be reflected in revenue records. 3. The land’s area, location, and nature of use must comply with EWS eligibility guidelines.Suggestion:You should first verify the nature of the ongoing case — whether it’s related to ownership, possession, or partition. Until the court delivers a final verdict and the ownership becomes clear, the land is unlikely to be considered for inclusion under the EWS quota.If you’d like, you can also share details of the litigation and the EWS application — I can provide a more tailored legal response.
