Q: Delay in providing services as vehicle given for service/repair

My car (VW POLO GT TSI) was taken to the service center for gearbox repair on 5th of January . Since then car has been in the service center for more than 5 months, with no sign of resolution. Legally, what are my options.

Advocate Suhas answered
If the service provider do not specify the issue and not responding to the issue you can file a petition before consumer dispute redressal forum for deficiency in providing service. complaint has to be filed within 2 years of the cause of action. The court will not entertain the complaint after completion of 2 years except there are reasonable causes for delay in filing the complaint.

If it is inclusive of your ctc then you can send a legal notice to the ceo and hr of the company. Even after that they don't respond then a suit can be filed before labour court. If it's a personal debt then procedure is different he have to know the facts and documents to know if it's a recovery or labour issue.

It depends on the merits by which judge grants bail. It depends on the judge if convinced you can get bail. If it's under 498 A then it's bit difficult. Without brief facts could not give precise opinion.
