Questions Answered by Advocate Sudhakar Kumar

Q: Quashing of False and Retaliatory FIR under Section 528 BNSS

I seek legal advice regarding quashing of FIR No. 181/25 registered at Rohtas Police Station, Bihar. The FIR is completely false and retaliatory, arising from an ongoing family dispute and earlier FIR No. 325/24. Police have issued a notice under Section 35 BNSS and indicated that a chargesheet may be filed. What remedies are available before Patna High Court under Section 528 BNSS? What documents are required, and can proceedings be stayed?

Advocate Sudhakar Kumar answered
I can assist with a detailed assessment of your FIR and advise on the appropriate remedy before the Patna High Court under Section 528 BNSS. I will first examine FIR No. 181/25, the earlier FIR No. 325/24, the Section 35 BNSS notice and the available case records to assess the grounds for quashing and interim protection. Please share the FIR, notice, previous FIR and any relevant orders/documents. After reviewing them, I can explain the proposed legal strategy, required pleadings and next steps for filing before the High Court.

Q: Jhutha fir mere papa pe jhutha fir hua hai jabki wnki kio galti nahi

Mere cahcha aur wnke padosiyo ke bich khuch wiwad hua paise ke mamale me to mere cahcha ko ghar ghus ke mara aur mere bs cahcha ko hospital leke gye aur case krne ke liye sath le gye cahcha ne case kiya jisne wnko mara ajj wsne wlta case kr diya mere chacha pe aur to aur mere papa ka bhi naam le liya jabki papa bs hospital leke gye aur ladai me samil ni the mere papa pe bhi fir kr diya

Advocate Sudhakar Kumar answered
HinglishYah ek 'Cross-Case' (Counter FIR) ka mamla hai jo aksar samne wali party pressure banane aur compromise karne ke liye karti hai, isliye isme ghabrane ki bilkul zarurat nahi hai. Kyuki aapke pita ji us vivad me shamil nahi the aur sirf madad kar rahe the, aap sabse pehle unke bachaav ke liye Sessions Court me Anticipatory Bail (Aagrim Jamanat) ka aavedan karein taki police unhe giraftar na kar sake. Iske baad aap High Court me is jhoothi FIR ko radd (Quash) karwane ke liye petition file kar sakte hain, jisme aapke pita ji ki mobile location (CDR), hospital ke records aur agar wahan koi CCTV footage ho, toh wo unki be-gunahi sabit karne me bahut kaam aayenge. Sath hi, ek likhit aavedan (representation) jile ke SP ya SSP ko turant dein jisme poori ghatna ka vivran ho aur bataya jaye ki aapke pita ji ko isme jhutha fasaya gaya hai. Aap apne documents ke sath aage ki kanooni karyawahi ke liye paramarsh le sakte hain.EnglishThis is a classic example of a 'Cross-FIR' filed merely as a pressure tactic by the accused to force a compromise, so you do not need to panic. Since your father was not involved in the actual altercation and only assisted your uncle in reaching the hospital, you should immediately file an application for Anticipatory Bail in the Sessions Court to protect him from any unwarranted arrest. Following this, you can approach the High Court to quash the false FIR against your father, using evidence such as his mobile tower location (CDR) at the time of the incident, hospital admission records, and any local CCTV footage as a strong alibi to prove his innocence. Additionally, submit a detailed written representation to the SP/SSP of your district explaining the false implication and requesting a fair, impartial investigation. Keep all hospital receipts and medical documents safe, as they will be crucial evidence when you consult further for legal proceedings.

Q: Need Divorce In Lowyer Muzaffarpur

Mai apne husband se talakh lena chahti hu vo bahut sarab pite h aur marte h mujhe galiya dete h mere ghar walo ko

Advocate Sudhakar Kumar answered

Q: Parents are beating me for I'm not obeying them

I’m a 23F, but my parents control everything. They booked a school van/man to take me to college, don’t let me go outside or even open windows. I recently moved to a separate room for privacy, which upset them because they can’t spy on me 24/7. During my mandatory 3-month Bangalore internship, my father hired someone at my hostel to monitor me and forced 24/7 location sharing. I only went work↔hostel. Today I was hit with a rod, yesterday with slipper, and my hair was pulled. I have video.

Advocate Sudhakar Kumar answered
English Response :As a 23-year-old adult, you have fundamental rights to life, liberty, and privacy. What your parents are doing is completely illegal. The physical abuse you faced constitutes Domestic Violence and criminal offenses. My advice is to secure your video evidence on a cloud drive. You are legally free to leave the house at any time and preventing you is a crime. Call the Women Helpline 1091 or Emergency Police 112 immediately if you feel threatened. You can file a formal Police Complaint FIR regarding the physical assault, and also file a petition under the Domestic Violence Act to get a Protection Order from the Magistrate to ensure your safety.Hinglish Response :Ek 23 saal ki adult hone ke nate, aapke paas azaadi aur privacy ka pura fundamental right hai. Aapke parents jo kar rahe hain wo legally galat hai. Jo maarpeet aapke sath hui hai, wo Domestic Violence aur criminal offense ki category me aati hai. Meri advice hai ki aap apne video evidence ko kisi cloud drive par safe rakhein. Aap apni marzi se ghar chhodne ke liye swatantra hain aur agar wo rokte hain to ye crime hai. Khatra mehsus hone par turant Women Helpline 1091 ya Police 112 par call karein. Aap in physical assaults ke khilaf police station me FIR darj karwa sakti hain, aur Domestic Violence Act ke tahat court me case file karke Magistrate se Protection Order bhi le sakti hain taki aapko police protection mil sake.

Q: 498A case against husband and in laws for dowry and cruelty

Can we file 498A directly through court? My lawyer submitted the petition to junior magistrate then essay writing happened my family members recorded their statements. An d now notice has been issues. What will happpen next as by when chargesheet will file?

Advocate Sudhakar Kumar answered
English Response :Yes, a case under Section 498A can be filed directly before the court, which is known as a Complaint Case. Since the Magistrate has recorded the inquiry statements of your family members and issued a notice/summons, it means the court has taken cognizance of the offense. Regarding your question about the chargesheet: since this is a direct complaint case in the court and not an FIR registered by the police, there will be no police chargesheet. The next step is that the accused persons will have to appear in court upon receiving the notice and seek bail. After their appearance, the court will record 'Evidence Before Charge' (pre-charge evidence). Once that evidence is recorded, the Magistrate will formally frame charges against the accused, and the regular trial will beginHindi Response :Yes, aap 498A directly court me file kar sakte hain, jise Complaint Case kaha jata hai. Jaisa ki aapne bataya ki statements record ho gaye hain aur notice issue ho gaya hai, iska matlab Magistrate ne cognizance le liya hai. Aapke chargesheet wale sawal ka jawab yeh hai ki: direct court case me police chargesheet file nahi karti hai kyunki ye police FIR nahi hai. Ab next step me accused (aaropi) ko court me notice milne par appear hona hoga aur bail leni hogi. Uske baad 'Pre-charge Evidence' (charge lagne se pehle ki gawahi) hogi. Is gawahi ke aadhar par court un par formally charge (aarop) frame karegi aur aage ka trial shuru hoga.
