Q: Manipulated Criminal Case against us

How to challenge a false criminal case ?The dispute was totally commercial.The person who made FIR was delivatary frame criminal case in a commercial matter.Finance company provided loan against hire purchase of machinery in supplier account (our account) But He was trying to manipulate the whole situation after loan disversed in our account.In stead of one machine for manufacturing unit he ordered for several units and start selling.Finance company was given 70% loan amount and balance was suppose to made by him.We had supplied him around 50% of ordered goods and demanded balance money for rest orders which was already ordered/imported for him.Finance company was demanding the Final invoice.And we was demanding balance payment to him.But he was not made the balance payment and made police complain against us under cpc 406,420 and 506.As I thinks if any supplier fault he can easily inform to the Fin. company for not got his ordered good.The main issue has been left behind.What to do?

The available remedy of aforesaid fact are- 1- To get anticipatory bail against whom the fir have been registered.2- To file Criminal Writ for quashing of fir.3- To file an Application U/s 482 if charge sheet is submitted before the Court.

If a false first informant report has been registered against you under Sc/St act and in same matter a civil dispute is pending. The available remedy is to file Criminal writ before the Hon,ble High court for quashing of fir.If charge sheet is submitted before the Court you can file application U/s 482 Cr.P.C. for quashing of charge sheet.
