The High Court of Kerala, through learned judge, Justice P.V Kunhikrishnan in the case Pauly Vadakkan vs Lulu International Shopping Mall Pvt. Ltd. (WP(C) NO. 29749 OF 2021) observed that prima facie, malls cannot collect parking fees.it's illegal and the facilities has to be provided by the malls and theaters but the question raised by highcourt left unanswered and The Development Control Rules and Municipal Acts of almost all cities across India are silent on parking charges. The same rules, however, want all residential and commercial establishments to have adequate parking capacity to discourage people from parking on the roads
