Q: Can a person with FIR leave country ?

FIR registered against the family but name of 1 family member not mentioned in FIR.. only relation is mentioned...can that member leave the country? how can a person go abroad if he has a police case?

Only registration of FIR does not bar you to leave country until unless further action has been taken I.e. arrest or challan presentation. It also depends on the nature of allegation means under which section FIR has been registered and the role attributed to the accused.



Q: Can a review petition be filed if the case is disposed off in HC

This is relation to my father's accident case. The case was pending before the High Court of chandigarh and Haryana since 2001. I was checking the case status online and found that the case has been dismissed by the judge around 3 months back. No notice of hearing was received by us and also our lawyer did not intimate us about the proceedings. It is only when I was checking online the fact came in our knowledge. Can we file a review petition before the court or should go to supreme Court directly? Can the delay be condoned? Please note that judgement copy was not served to us.

It depends on the nature, how it has been dismissed. 1. Dismissed in default, 2. On merits. If it is no. 1 then you can file an application and if it is no. 2 then you can file review but in case of review there should be facts, which have been omitted by the Hon^ble Court

If it's written argument then yes but if it's written statement then only with prior permission of the hon'ble court. Generally it's depends on court, whether to permit or not but all courts do accept written submissions/ arguments in general but in case of written submissions you have to taken concession of the court, if it's time barred.
