Q: Filed divorce case in India- looking for legal opinion
Hi, I got married in India 2 years back. The marriage didnt go well and wife asked for divorce. After I filed divorce petition in court she started asking hefty amount as alimony. My wife is still working.I have travelled abroad while case is still in mediation stage. The mediation stage will end in a month and then move to evidence stage. Do I need to travel back to India during evidence stage or I can attend evidence stage after 1 year or so?nBoth of us still hold Indian passports

Once the evidence in court has started, you have to come to India for that. In fact, as you have missed your dates in mediation, it will go a negative point in your case if you are the petitioner but no adverse effects would be there because of this. But you have to appear in court on dates of evidence.
Q: Brother trying to kick me off family property
My brother is a narcassist and thinks he is entitled to everything. He is currenty threatening to kick me off the family property owned by our father which my family and i have resided on for the last 12 years. He is also threaening me with legal actions. If the property is a family property then your brother can't do anything and can't kick you off from the property. There is your absolute right if the property is your ancestral property and also there is absolute right if the property belongs to your father only

Elder brother's (govt employee) wife asking 15 lac for to sign divorce papers bt we find out that she secretly got married around 4-5 years ago and have a child of 3 years age. My elder brother and that girl got court married around 8-9 years ago, they never live together never have any childSo can i get my elder brother get married without divorce bcz that girl is already married and have a child? No, your brother can't get married again till he is not divorced as that marriage would be illegal. Even the second marriage of your brother's wife is illegal. Your brother can file for divorce in the court on the ground of Bigamy if he have sufficient proof that his wife has done second marriage and have a child with her second marriage.
Q: What can I do if IO is not submitting chargesheet?
Last year I got involved in a fight with my neighbor and police arrested me. But IO have not submitted the chargesheet yet and because of this my PCC is not getting cleared and I am facing issues in my new job. Kindly help

You should take help of an advocate and go for filing of application to avail the status report on FIR of your case. Once the application for status report would be filed by you, IO would be answerable to the court for filing of chargesheet.
