Q: Summons to one of several defendants.

Summons issued to company and its director by NCDRC for appearance. Company and one directors received the summons. It could not be delivered to second director. After praying, the court issue orders for dasti summons for petitioner to deliver now at the residence address of the 2nd director. When visited it was conveyed by security man at the gate after inquiring from inside the house that person is not at home and don’t know when he will be back. It is indented to visit once again. We have e-mail ID and the whatapp number of the person. Can the dasti summons be served by these means? Is the option of taking the help of local court for service of dasti summons by bailiff is available ?

yes. u can serve the summon by way of email and wats aap. but u have to attain the order from the court in that prospect. you can also take a person from local District court summon branch for service of the summon



Q: Marriage fraud and legal status of marriage

My boyfriend's parents were not ready to consent to our marriage and got him married to somebody else by threatening suicide. My told me about this but said forced marriages are not legal and married me afterwards without telling his parents but didn't agree to register our marriage fearing his parents will come to know, who are not his real parents( his parents died in accident when he was infant and he has been raised by his tau and taai). It's been five years, he never took me along. I have been living with my parents since marriage. He kept on giving excuses about financial problems etc. Now he told me has a daughter with his first wife and he can't leave his daughter but also don't want to stop talking and meeting me. He is threatening me with suicide if I don't forgive him. I don't want to fight any legal battle as I will loose mental peace and my life will be spent in court only. Also his parents are powerful people. What should I do and what is legal status of marriage?

your marriage is void as per law. it means that your marriage is not legal in the eyes of law. despite being married if person perform marriage without giving divorce to his first wife, second marriage is void. similarly if he has maintain physical relationship under the inducement that he is unmarried then criminal complaint lies under section 376 of Indian penal code



Q: Annulment of a arya samaj certificate made by illegal maners

Hey.. My cousin lives in Germany when she came India 2 years back .her boyfriend forcefully made her signed on a arya samaj certificate under hindu marriage act and clicked her pictures with him as a procedure of arya samaj marriage.. But This certificate was arranged by bribing witnesses and the authorities involved in it According to hindu marriage act PHERE’s are very important but Phere’s never happened and after signing she came back to her family house they never lived together not even a single day .. And after 15days she went back to Germany.. she is still there but from past 1year that guy is blackmailing her and asking for money she has already given 2-3lacs to him but now his demands are increasing day by day ..what she can do to void this arya samaj certificate so that he cannot blackmail her again .. ??

you can file the case under section 12 of the Hindu marriage act for annulment of marriage as well as filing the criminal complaint against the said person before the SSP, of your city. the person can represent her through special power of attorney while she is in Germany



Q: Builder Ignored Rera judgement

I have filed a case ADC 1501/2019 in Rera, Punjab court and won the same in favour on 29-4-21 . Court has given orders to refund the amount with interest. Till date the builder is silent. My Advocate has filed caveat in Rera and Highcourt too and marked mail to the Builder but even after 60 days no response recieved. Now my advocate is demanding huge amount to file another case in Highcourt which is beyond my financial limit. Need help please

for this purpose, civil suit for recovery of money need to be file before the court as this is a contract agreement not hence does not come under the consumer law. I will suggest u to go for the civil suit for recovery of the money
