Q: regarding cancellation of sale deed

My cousin brother sold the residential plot land from front side of a plot, so i want to know can my family cancel the registration of sale deed of that plot or not.We comes under HINDU religion.

You can get cancelled the registration deed from court once you are able to prove that the sale was not done as per the law and consent of the other Coparcenar. Thereafter the court will decree in your favour and accordingly the deed will be declared null and void.

Q: Ancestral Undivided Property sold without consent of other coparceners

I have an ancestral property in Raghunathpur Block, Siwan, Bihar. My father is 5 brothers and 4 sisters. My grandfather deceased in 1988 and grandmother in April 2005. The wife of one of the uncles who is also dead now sold her share of property to a neighbour. Now the issue here is1. There is no registered division of any of the property my grandfather left behind but for some certain share of land has been divided amongst the brothers of my father and himself on a plain white paper and the remaining has not been divided in any manner.2. The person has got registered from her the undivided share along with the divided share of her husband and the person who has got it registered is now physically acquiring and taking possession of the land.3. The registration of the land has been done more than 18 months ago.4. File a suit for declaration permanent and mandatory injunction.once the suit is finalised you can go for partition suit and accordingly can divide the share of the property as per rights of each shareholder.
