It really depends upon what type of offence is in the complaint. For the police to act, they will have to register an FIR after which an investigation is done. If police does not register an FIR, then we can go to the court and get it registered under code of criminal procedure.

Q: How to get out of complaint filed for harassing a girl and cyber crime

After breakup I send a pic of her to her family which was not actually vulgar but they filed a complaint that there was no relationship and I was just harassing her and they asked me many times not to do it which is not at all true.

please go to the police station and get your complaint registered. Inform them that you are not harassing but only sent a picture which was not vulgar. this should help you and also inform the family that you will not be sharing any photos going forward.

Q: Complaint against partner for threatening and not bearing losses.

Sir Ive created a partnership with one person for a call center project in which we comes under very big loss. And we have mentioned in our agreement that well face 60-40 percent loss and profit in which 60 percent will be his and now hes threatening me by saying that Ill have to bear all the loss by myself otherwise he has links in big courts by which he will put charges on me. So I need to know how can I get out of this as Im ready to pay my 40% of loss, but hes planning to do something else

Please prepare a summary of your greivance and go to your nearest police station and get your complaint stamped. once this is done, the police may call your partner and ask to settle the matter. if not, consult a lawyer and the lawyer will tell you about the legal recourse.

Q: Complaint against flipkart for not replacing defected product.

I've purchased a smartphone Honor 8 Pro (Cost 30000) through flipkart and after 2-3 days of usage i felt that my phone was overheating near the camera area while using the camera. So I applied for replacement for which they sent a technician to verify. The technician asked me to start a video recording before his arrival. Then after that he came and just installed a software which showed the battery temperature to be around 44 degrees which he said is not very high but even at that time the phone was very hot and even I was not able to keep it near my ear during phone calls. Then flipkart rejected my return request. Now again when I applied for the return they said that it's against the company policy I am not eligible for return but my phone is still overheating and they are asking me to visit the service centre. What's the purpose of buying online item when I have to visit the service center just after a week of purchase. It would be very kind of you if you could help me out.

You can approach the district consumer forum, considering the value of the phone is Rs30,000/-. Flipkart, as a seller, has to take complete responsibility for the product they sell on their website. You can approach the district consumer forum by yourself or you can take a lawyer's consultancy. thank you.

Please go to the nearest police station and file a complaint of cheating. The police officer will stamp the complain and give it to you.you can then send it to the person who cheated you and tell him/her that you will go ahead with the case. In addition to this, please file a complain with the cyber cell police wing in your district.
