Q: What legal action can be taken on recovery agents of bank

I have taken a loan from 2 NBFC’s in 2014 in lucknow, at present I am in Noida, at the time of loan I was working, unfortunately after few months I lost my job but I kept on paying the EMI for 8-9 months, I was job less for approx. 1.6 years. After I got a job I contact both the finance company for settlement of my loan, but I didn’t received any response from F, So I settled the loan of B & again contacted F in Aug 2016 for settlement but again no response. Know F recovery person(Female callers) is calling my sister-in-law, friends & company and harassing them they called them 75 times although they are having my number they are abusing me and saying to pay the money within 24 hours. I told them that when I contacted you then you didn’t replied and now you want the money within 24 hours. I need some time to arrange then she said if you will not pay the money within 24 hours then team will lift my wife and kids we know when they are alone. What should I do?

First of all kindly consolidate the details of liability of the loan amount with interest up-to till date at your end. And make a note of it that how much amount you need to pay to both of nbfc. Now go to the nearest police station and launch a FIR against the number from which you got the call for life threatening and harm with injuries for your family.

Q: Procedure to file a case of medical negligence

I want to file a medical negligence case against a hospital as I see lapses due to which my mother passed away.

Before proceeding kindly get the death summary report and injury report with consultation prescription and paid bills with autopsy..it is important to cross check the incidence happened in hospital comes under neglugecy or not by an advocate

Q: Will CDR and whats app chat will be admissible in trial court?

I have following question to ask.. 1-Can anyone get someone else CDR. 2- What if he got CDR by illegal means and produce as proof. Is it not a crime? 3- What if someone has whats app chat of the person by hacking or web.whats app portal without the knowledge of the person. Is it not Crime? Can it be treated as a proof in court or FIR??

1) No one can get the CDR for any another person. 2) To get CDR from any source is illegal and if he/she has the CDR it means he/she committed the offence along with the offender who has provided the same.

Q: Need to get father's name corrected in document

Mere 10 ki document m mere papa ke name ki spelling jo h wo kuch aur hai and aur sare document m jo h wo alag h to m kya kr sakta hu

Kindly get in touch with the education board office they will tell you the name correction procedure for the same. Otherwise you can use affidavit for the name correction everytime wherever you have to use your 10th marksheet

Q: Boy blackmailing through means of pictures and recordings

Sir a boy is harassing me mentally and blackmailing me through some means of photos and recordings claiming to be mine. he is threatning me to make them viral over net. i have facebook conversation of him with me doing so. i wanna take action over but i dont know what rubbish he has bcz i have not done anything unfair or illegal. one thing more sir i dont wanna disclose matter to my family otherwise they will blame me without my fault. please suggest me for the best. i have complaint of him over 1090. please sir reply me with ur guidance.

1) Sir a boy is harassing me mentally and blackmailing me through some means of photos and recordings claiming to be mine. - "Have you received any claimed recording and photos that shows your involvement??" 2) i have not done anything unfair or illegal - "Do you have done any illegal or unfair with him in previous??" 3) he is threatning me to make them viral over net. i have facebook conversation of him with me doing so. - "Kindly keep all the electronics evidence like chat history, transactions of mail or photograph video" 4) And go to the nearest police station for filing the case they will assist you surely. after that you can take him to the court only.
