Q: Regarding returning of Wedding Expenses & Gold & Silver gifts

I got married in April 2025 , due to childhood orchidopexy surgery I get infertility issues now facing fraud & impotency case which is actually false .So my wife is demanding entire wedding expenses plus all the clothes & shagun that they given us , including all the jewellery.As she is Govt. Class 1 officer so she cannot claim alimony.Can you please help me if I contest will I have to return all the wedding expenses and the jewellery that they gifted us in the wedding like chain , rings .

सिर्फ infertility (orchidopexy surgery के कारण) को impotency नहीं माना जाता। Impotency का अर्थ है consummation करने में असमर्थता। यदि आप वैवाहिक संबंध स्थापित करने में सक्षम हैं, तो Section 12 Hindu Marriage Act के तहत पत्नी का दावा कमजोर रहेगा।Alimony (भरण-पोषण):यह धारणा गलत है कि Govt. Class-1 officer होने पर पत्नी alimony नहीं मांग सकती। Section 24 Hindu Marriage Act एवं Section 25 Hindu Marriage Act के तहत कोर्ट दोनों पक्षों की आय देखकर निर्णय करता है। हालांकि, उसकी अच्छी आय आपके पक्ष में एक मजबूत factor है जिससे alimony कम या nil हो सकती है।Wedding Expenses की मांग:कानून में ऐसा कोई प्रावधान नहीं है कि पति को पूरे शादी के खर्चे वापस करने पड़ें। यह मांग कानूनी रूप से enforceable नहीं है।Jewellery/Stridhan:जो गहने पत्नी को दिए गए (stridhan) हैं, वह उसे लौटाने होंगे।जो गिफ्ट आपको या आपके परिवार को दिए गए, वह वापस करने की बाध्यता नहीं है, जब तक विशेष परिस्थितियाँ न हों।

Q: notice served after 3 months of giving notice , after filing petition

notice given to accused on date - 15.10.2025after waiting for 3-4 days notice did not get served , i waited for 30 days and did an enquiry in post office they said gave me a reply in written ( article untraceable )so i filed the petition after expiry of 15 days plus calculating usual time of notice getting served generally (4-5 days ) ,court considered notice being served as given on correct address but after expiry of 2 months from filing of petition notice got served now what should i do

आपके द्वारा बताई गई स्थिति में यह महत्वपूर्ण है कि Section 138 Negotiable Instruments Act के अंतर्गत “service of notice” का प्रश्न तथ्य और कानून दोनों पर निर्भर करता है।1. यदि नोटिस सही पते पर भेजा गया था, तो कानून में “deemed service” का सिद्धांत लागू होता है, जैसा कि C.C. Alavi Haji v. Palapetty Muhammed में स्थापित किया गया है।यानी, भले ही नोटिस वास्तव में प्राप्त न हुआ हो, सही पते पर भेजने से सेवा मान ली जाती है।2. आपने पोस्ट ऑफिस से “article untraceable” का प्रमाण लिया है और उसके बाद 15 दिन की अवधि + सामान्य डिलीवरी समय के बाद शिकायत दायर की — यह एक कानूनी रूप से सुरक्षित approach है।3. अब 2 महीने बाद नोटिस का सर्व होना आपके केस को कमजोर नहीं करता, क्योंकि:अपराध (cause of action) पहले ही complete हो चुका था।बाद में सर्व होना procedural irregularity माना जा सकता है, substantive defect नहीं।4. यदि विपक्ष इस आधार पर आपत्ति उठाता है, तो आप यह तर्क रखें:नोटिस सही पते पर भेजा गया थाpostal delay/defect complainant के खिलाफ नहीं जा सकताdeemed service लागू होगीआगे क्या करें:केस को merits पर आगे बढ़ाएंयदि जरूरत हो तो postal receipt, tracking report और post office reply को evidence में मजबूत तरीके से पेश करेंकिसी भी technical objection का जवाब उपरोक्त जजमेंट के आधार पर दे
