Questions Answered by Advocate Priyanka Sethuraman

Q: MACT compensation award details in case of 9% per annum interest

my question is in a MACT compensation award judgement , if a judge gave award of 20 lakhs of compensation with 9% interest per annum from the date of filing till deposit means how much amount the deceased family will get if the case was about 4 years duration???

Advocate Priyanka Sethuraman answered
sir, the calculation would follow as;20,00,000/- X 9% for number of days calculated from the date of filing till the date of deposit is made ( the days for which the petition was dismissed for default will be excluded)..... i will be able to say the accurate calculation if the date of Petition filed and the date of deposit made and the Dismissed for default period is known.

Q: What is the meaning of Exp.Evi in a motor accident case

What is the meaning for this :Exp.Evi. As per order in I.A. /18 dt 19-01-2018 exparte order passed against R1 on 2701-2017 set a side today. Cr of R1 filed Enquiry by Next Purpose:EX-PARTE EVIDENCE

Advocate Priyanka Sethuraman answered
Ex-parte evidence is the stage where all the Respondents who are parties to the proceedings does not come forward to contest the case and has no proper representation to defend them selves, the Petitioner is given a right to just prove his claim before the court and the non-contesting respondents will be liable to pay the compensation decided by the Court.

Q: Legal procedures against fake police complaint

Hi How to close the fake police complaint given by someone but police inquired the case but not filed FIR. How to close this complaint... Just leave as it is or Do we need to go police station and ask police to close the complaint..

Advocate Priyanka Sethuraman answered
Kindly ask for the status of the enquiry made by the Police Officer. In case if the complaint against you is dropped as there was no mistake on your part you will be on the safer side. But if the same is pending there will be an issue in future.

Q: Authority gives two different statements in the same case

Respected All, In a registered criminal case IPC 420,467,468,471 of a POST OFFICE against a employee- 1- Charge sheet given to concern employee by post office says that employee left the office at 2.30 afternoon/daytime? 2- In his statement to court, same authority i.e.post office says employee left office at 3.30 daytime? Which point 1 or 2 should be true, valid, and acceptable in court? Who will get benefit of two different thought at a time and how? What must be the final decision according to legal Indian laws? Always Thanks.

Advocate Priyanka Sethuraman answered
The timing stated in the Court has much more validity since the FIR and Charge sheet is framed by the police authorities based on the Complaint lodged and there is a change of misleading the same. The timing difference can be elicited in the cross examination and the Court has the power to decide which is the correct timing based on other evidences putforth..
