Q: Procedure to withdraw case 498A as exparte divorce already obtained
I had filed a 498a in July, 2015 against my husband but the chargesheet was never filed. My ex-husband had already obtained an ex-parte divorce in May 2017. I want to withdraw the 498a without involving my husband. How can I do it?

Since the offence under Section 498a is a criminal offence, so for withdrawing the same you will need to file an application of withdrawal of case to the High Court of jurisdiction. Please mention that this is an application for the High Court to exercise its powers under Section 482 of CrPC and attach written affidavits from all members of your family stating that they have no objection to this withdrawal.
Q: What to do if builder is not getting OC certificate ?
Hi Sir, This is here. We have selected a ready to move flat to purchase, and already paid the booking amount. The builder has mentioned that they have already applied for OC, and they will write in agreement to provide the same. However, when I checked the acknowledgement, it's been already one year passed. I believe, they should have received the OC by this time. Could you please let me know you point of view? And also, if there is any way to know the reason behind this delay.

Hi,You need to send a notice to the Builder to apply and handover occupancy certificate within one month from the date of issue of your notice, if the Builder does not respond, file a complaint in the consumer forum. Builder cannot escape the liability for securing the Occupancy certificate.

Hi, Charge sheet can be quashed on one ground only, if there is no prima facie case against the accused. Prima facie means, even if all the averments of the prosecution is accepted as true then also all the substantive ingredients of the alleged offence is not satisfied.
