my father's first apeal pending in highcourt to declaration and null /void will of anchestral house against uncle and his son.ow i am not party of suit neither in session nor in apeal.ow i also want party or file new suit in session .can i do it. will it res judicata.

Yes, since your rights are accrued through your father and it's an ancestral property, therefore, whatever decision will be given by the High Court will be binding upon you through your Father. Therefore, do not proceed to file fresh suit.. Since locus would be identical to the previous suit filed by your father.
